Should we brand the company or the loan officers?
Both, in that order of effort. Borrowers choose a person and agents refer a person, so the originator carries the relationship. The firm's job is to make all of them look like one business.
Does our material need the licence identifier?
Advertising rules require certain identifiers on lender material, and the safest approach is to build them into every template. Which ones apply where is settled by your compliance officer, since the licence is yours and state rules differ.
Can you co-market with our agents without breaking RESPA?
Only where each side pays fair market value for what it receives, and the split is documented. A free flyer or a subsidised open house is what turns into a Section 8 problem. We build the material and the cost split, and your compliance officer or attorney approves it before anything runs.
Can we advertise a rate?
You can, with everything the rule requires travelling alongside it, which is more than most people expect. A quoted rate brings its APR and the terms behind it into the same piece, and your NMLS ID appears too. We write to your compliance team's template rather than inventing our own.
