Can advisers use their personal numbers with clients?
It is common and it causes two problems: the client goes with the adviser who leaves, and there is no record of the advice given. Move clients onto a firm number, and settle the retention question with your compliance officer before anybody objects.
Can we send market updates on WhatsApp?
To clients who agreed to receive them, in wording your compliance officer has approved, and without performance claims or screenshots. Facts about a rule change or a tax deadline are the safest content. Anything reading as a recommendation belongs where the record is kept.
A client messages us in a falling market asking whether to sell everything. What do we reply?
Reply with the prepared holding message: the adviser has seen your note and will call at a stated time. Do not give a recommendation in chat. Move the conversation to a recorded call or meeting, and note the discussion on the client file.
Can a relationship manager add clients to a WhatsApp group for market commentary?
No. A group shows every client's number and invites replies that read as advice in public. Any market commentary should come from the firm's approved channel and wording, to clients who agreed to receive it, and carry the firm's standard disclosures.
Can we show our past portfolio returns in ads?
